Participant Waiver

This is the waiver every participant signs before using the sauna or cold plunge. Printed copies are at the trailer — it's published here so you and your guests can read it in full beforehand.

In consideration of being permitted to use the wood-fired sauna, cold plunge tubs, and related facilities and equipment operated by Mobile Cold Plunge and Sauna LLC (“the Company,” “we,” “us”), I, the undersigned participant, agree to the following. I understand this is a legal document that affects my rights.

1. Voluntary Participation & Assumption of Risk

I am voluntarily choosing to use a high-heat sauna and/or cold-water immersion plunge. I understand these activities carry inherent risks that cannot be eliminated, and I knowingly and voluntarily assume all such risks, whether described here or not, including but not limited to:

● Heat-related illness: overheating, heat exhaustion, heat stroke, dehydration, fainting, dizziness, nausea, and burns from hot surfaces, stones, the heater, or steam.

● Cold-related effects: cold shock response, involuntary gasping, hyperventilation, temporary loss of breath control, cold incapacitation, numbness, and after-drop.

● Cardiovascular stress: rapid changes in heart rate and blood pressure from heat, cold, and hot-to-cold transitions, which may be dangerous for some individuals.

● Slips, trips, and falls on wet floors, ramps, steps, decking, or when entering/exiting tubs, and injuries from disorientation.

● Drowning or near-drowning risk associated with any water immersion.

● Aggravation of any pre-existing medical condition.

2. Health Representations & Contraindications

I confirm that I am in good physical health and have no condition that makes sauna or cold-immersion use unsafe. I understand these activities are not recommended for, and I should not participate if I have, any of the following without a physician’s clearance:

● Heart disease, high or low blood pressure, prior heart attack or stroke, or any cardiovascular condition.

● Pregnancy.

● Diabetes, epilepsy or seizure disorders, or fainting history.

● Respiratory conditions, or any condition affecting circulation.

● Recent surgery, open wounds, or acute illness.

● Being under the influence of alcohol, cannabis, or drugs (participation while impaired is prohibited).

I acknowledge the Company has advised me to consult a physician before participating, and that staff are not medical professionals and cannot assess my fitness to participate.

3. Rules & Safe Use

I agree to follow all posted rules and staff instructions, including: limiting session time as advised, hydrating, never blocking or closing both sauna vents while the heater is lit, entering cold water gradually, never diving, not using facilities alone when instructed otherwise, and immediately exiting and notifying staff if I feel unwell.

I will not allow any minor in my care to participate except as expressly permitted and supervised, and I accept responsibility for them where applicable.

4. Release & Waiver of Liability

To the fullest extent permitted by Texas law, I release, waive, and discharge the Company, its owners, members, employees, contractors, and agents from any and all liability, claims, demands, or causes of action for injury, illness, death, or property loss arising from or related to my participation, including claims based on ordinary negligence. This release does not apply to gross negligence or willful misconduct where such a waiver is prohibited by law.

5. Indemnification

I agree to indemnify and hold harmless the Company from any claims brought by me or on my behalf, including reasonable attorneys’ fees, arising from my participation.

6. Medical Emergency Consent

In the event of a medical emergency, I authorize the Company to call emergency services and to arrange emergency medical treatment on my behalf. I understand I am responsible for the cost of any such treatment.

7. Photo / Media Release (Optional)

I grant the Company permission to use photos or video of me for promotional purposes without compensation. On the printed form you accept this by initialling it, or decline by leaving it blank.

8. Responsibility for Damage

I am financially responsible for any loss of or damage to the Company’s trailer, sauna, cold plunge tubs, heater, equipment, fixtures, furnishings, liner, or any other property that is caused by me or by any guest, child, or invitee in my care, beyond normal wear and tear. This includes damage caused by misuse, negligence, failure to follow posted rules or staff instructions, rough or improper use of equipment, introducing prohibited items or substances into the water or sauna, or removing, defacing, or tampering with any equipment or safety device.

I agree to pay the full cost of repair or replacement of any such damaged or lost property, plus any lost booking revenue while the Unit is out of service for repair, and any cleaning fee required to restore the Unit to service. The Company may charge these amounts to the payment method on file and I authorize it to do so.

I am also responsible for the reasonable cost of remediation if I contaminate the water or facilities (for example, bodily fluids, glass, food, or foreign substances) requiring draining, sanitizing, or refilling beyond normal turnover.

9. Governing Law & Severability

This agreement is governed by the laws of the State of Texas. If any provision is found unenforceable, the remaining provisions stay in full effect. I agree that any dispute will be handled in the courts of Bexar County, Texas.

10. Acknowledgment

I have read this entire document, understand it is a release of liability and assumption of risk, and accept it freely. I am at least 18 years old (or the parent or legal guardian of the participant).

The printed form you'll sign at the trailer also collects your name, signature and date, an emergency contact, and a parent or guardian signature if the participant is under 18.
